Can Israeli Heirs Make a Distribution Agreement?
Heirs are permitted to make an agreement among themselves to distribute the estate in a manner that is different from the distribution specified according to law or as determined in a will. However, it is important to note that this is only permitted as long as the estate is not shared among the heirs.
In order for the distribution agreement to be valid, the agreement to distribute the estate differently than initially specified must be written down and express the particular agreement among the heirs.
Involvement of Other Parties
It is possible to submit the distribution agreement among heirs to a family court in order for it to be approved, but there is no obligation to do so.
The Registrar of Inheritance Affairs would not be involved in any such agreement and will not state it in the succession order or will probate order.
